These Terms of Service ("Terms") govern access to and use of the Rohetek platform ("Service") by restaurants, the agencies that manage them, and visitors to restaurant websites hosted on the Service. By using the Service, you agree to these Terms.
1. The Service
Rohetek is a software-as-a-service platform that lets restaurants build and operate a website, manage content, integrate third-party tools (Google Analytics, Instagram, Resend, PreDine, etc.), and accept contact form submissions and reservations from visitors. Each restaurant publishes its own site under its own domain through the Service.
2. Accounts
To manage a restaurant on the Service, you create an account with an email and password. You are responsible for keeping your credentials secure and for all activity under your account. Notify us at [email protected] if you suspect unauthorized access.
3. Acceptable use
You agree not to use the Service to:
- Violate any law or the rights of any third party.
- Distribute spam, malware, or harmful content.
- Attempt to gain unauthorized access to other accounts or to the underlying infrastructure.
- Scrape or harvest data from the platform beyond what its public APIs allow.
- Impersonate another business or individual.
We may suspend or terminate accounts that violate these terms.
4. Content ownership
Restaurants own the content (text, photos, menus, etc.) they upload to the Service. By uploading content, you grant Rohetek a non-exclusive, worldwide license to host, display, and distribute it as necessary to operate the Service on your behalf. We do not claim ownership of your content.
Rohetek owns the platform software, templates, and tooling. You may not copy, reverse-engineer, or redistribute the platform itself.
5. Third-party integrations
The Service integrates with external providers including Google (Analytics, Search Console, Tag Manager), Meta (Instagram), Resend (email), PreDine (reservations), DigitalOcean (hosting), and Cloudflare (DNS / CDN). Use of those features is subject to those providers' own terms and privacy policies. We are not responsible for the actions or availability of third-party providers.
6. Fees and payment
Pricing is communicated directly to each restaurant or agency. Failure to pay may result in suspension of the Service for that restaurant.
7. Termination
You may terminate your account at any time by emailing [email protected]. On termination, your restaurant's site will be taken offline and your data will be retained for 90 days for potential recovery, then deleted.
We may terminate or suspend accounts that violate these Terms, with or without notice depending on the severity.
8. Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Rohetek shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid Rohetek in the twelve months preceding the claim.
10. Changes to these Terms
We may update these Terms. Material changes will be communicated to account holders via email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.
